These Terms of Service (“Terms”) govern your access to and use of the NumberEdge Racing website, applications, and services (collectively, the “Service”) operated by NumberEdge Racing LLC (“NumberEdge Racing,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not intended for children under 13.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at mike@numberedge.com if you suspect unauthorized access. You agree to provide accurate information when creating an account and to keep it current.
Paid subscriptions to the Service are billed in advance on a recurring basis (monthly or annually as selected at checkout) and automatically renew for the same term at the then-current rate unless you cancel before the renewal date. Payments are processed by Stripe; we do not store your full payment card information.
You can cancel at any time from your account page or by emailing mike@numberedge.com. Cancellation takes effect at the end of the current billing period, and you will retain access until then. Except where required by law, paid amounts are non-refundable, and we do not provide prorated refunds for partial billing periods.
We may change subscription pricing, features, or plans, and will give reasonable advance notice of material changes. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
You agree not to:
You retain ownership of data you submit through the Service (for example, your own race runs, garage entries, opponent notes, or driver claims). You grant NumberEdge Racing a non-exclusive, worldwide license to host, store, process, and display your content solely to operate, improve, and support the Service. You are responsible for the content you submit and represent that you have the rights to submit it.
The Service aggregates and analyzes publicly available race results from the National Hot Rod Association (NHRA) and other sources. NumberEdge Racing is not affiliated with, endorsed by, or sponsored by the NHRA or any sanctioning body, track operator, or series. All trademarks and class names are the property of their respective owners.
The Service, including its software, design, prediction models, aggregated analytics, copy, and branding, is owned by NumberEdge Racing LLC and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or internal business use in accordance with these Terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. Predictions, dial recommendations, opponent statistics, and any other analytical output are informational only and do not guarantee any outcome on race day.
TO THE FULLEST EXTENT PERMITTED BY LAW, NUMBEREDGE RACING LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST RACE ROUNDS, LOST WAGERS, OR DATA LOSS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold NumberEdge Racing LLC harmless from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time for violation of these Terms, for non-payment, or to protect the Service or other users. You may stop using the Service and delete your account at any time. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability, dispute resolution) will survive termination.
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider, with the seat of arbitration in Missouri, except that either party may bring qualifying claims in small-claims court. You and NumberEdge Racing LLC each waive the right to a jury trial and to participate in any class or representative action, to the extent permitted by law.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date and, where reasonable, notify you by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
